1:10,000, the map shall be on a scale of 1:25,000, or 1:50,000); and the area in which the objects concerned are located, as described in the provisions of sub-items a) and b) of item 13, shall be specified on a map on a scale of not less than 1:5,000.

 

(Notification of Application for Permission for Aerodrome Establishment)
Article 78. The items that shall be notified and posted in the case of application for permission for the establishment of an aerodrome, as prescribed under the provisions of Article 38 paragraph 3 of the Law, shall be the items specified under the same Article, the same paragraph of the Law, and Article 76 paragraph 1 item 1 to item 5, item 8 and item 9.

 

2. The provisions of the preceding paragraph shall be applied accordingly to a case in which the Minister of Transport establishes the aerodrome.

 

3. The provisions of paragraph 1 shall be applied accordingly to the case of the application for permission for the construction enforcement plan for the establishment of the New Tokyo International Airport provided under the first half of paragraph 3 of Article 55-(3) of the Law.

 

(Aerodrome Establishment Criteria)
Article 79. The aerodrome establishment criteria provided under Article 39 paragraph 1 subparagraph 1 of this Law (criteria of location, structures and others for the proposed aerodrome establishment), (including the case when it is applied according to Article 43 paragraph 2 (application for alteration of aerodrome or air navigation aids) and Article 55-(3) paragraph 2 of the this Law (application for establishment and others of New Tokyo International Airport) are enumerated as follows:
(1)With reference to any structures, plants or other objects which are located around the aerodrome concerned, the Minister of Transport shall
acknowledge that none of these will obstruct the landing and takeoff of aircraft. The same shall not be applied, however, to the case whenever said obstructions are acknowledged to be removed by a scheduled date for the completed construction of the aerodrome concerned.
(2)The holding pattern airspace area (defined as a specifically designated airspace in the vicinity of the aerodrome, established to maintain the least minimum safety airspace area for the aircraft which intend to land at the aerodrome; hereinafter defined as such) shall not overlap any other existing holding pattern airspace of any other aerodrome.
(3)A terrestrial aerodrome shall, except where it is acknowledged that there are particular extenuating factors, provide an appropriate runway, landing area and taxiway satisfying the criteria prescribed in the following table in accordance with the respective landing area categories.
